Family Blowup Leaves Joliet Man and Son Dead, Second Son Seriously Hurt

Police believe an argument escalated to the point where one son shot his father and brother, prompting the brother to return fire.

A family fight erupted into violence Saturday night, leaving a man and his father dead of gunshot wounds and a second brother seriously wounded.

Joliet police were called to an apartment at 122 E. Cass St. shortly before 10 p.m. and found Roberto Gutierrez, 46, of Joliet, and his 22- and 23-year-old sons with injuries from gunfire, Cmdr. Brian Benton said Sunday.

Roberto Gutierrez died at 10:20 p.m. at Provena St. Joseph Medical Center in Joliet and Fernando Gutierrez, 23, of Addison, at 10:12 p.m. at Silver Cross Hospital in New Lenox.

The 22-year-old son, whose identity wasn't released, underwent surgery at Provena for two gunshot wounds to the abdomen and one to the leg, Benton said. He is expected to survive.

What police have been able to piece together is the three men had been fighting throughout the evening, and Fernando Gutierrez eventually pulled out a handgun and shot his father and brother, Benton said. Despite his injuries, the younger brother was able to retrieve a gun from another room and returned fire on his brother, he said.

It's not clear what the fight was about, but the family has been known to have loud arguments, Benton said.

Fernando Gutierrez, who has a criminal history under his own name and possibly an alias, was described as "acting erratically" before the shooting, Benton said. Toxicology tests are being conducted.

One weapon was found outside the residence, and the other recovered after police obtained a search warrant to go into the home, Benton said.

No charges have been filed against the surviving brother because it appears he shot his brother in self-defense, but the final decision will be made by the Will County State's Attorney's Office.

Concealed carry is for normal every day people to have the means to protect themselves and family against the low life's that rob, rape, and intimidate. In every state that has concealed carry laws, crime goes down.

Very true Jim.I moved to Texas a while back to care for a sick family member and everybody has a gun there.I noticed one thing though,crime rates weren't half as bad as they are here,the reasoning for this is more than likely people stop to think when they're in a concealed carry state.I mean seriously would you still carjack someone if you knew there was a possibility you're gonna lose your life for it?David,I also agree with you due to the fact family violence is getting so rediculously out of hand these days.It's just a very sad day when things like this occur withing families.And if the States Attorney's office files charges on this younger brother it would truly be proof of how corrupt our county is getting.The young man shot his brother to defend himself as well as his father whom unfortunately succombed to his injuries.This young man is going to be having enough grief as well as guilt on his hands for the rest of his life so hopefully Glasgow stays away from putting him through further unnecessary traumatization.Prayers to the young man and his family.

People make guns...they are not beamed from space..they are made by humans..To ban guns you have to remove the knowledge that lead travels fast when backed by exploding black powder...That is impossible..so is banning guns..And ask yourse

You know he is going to..it's all about conviction and getting a name in Will County...If the kid who saved his own life didn't have a FOID then he broke the law,if he is a felon,he broke the law,if he was drinking and returned fire he broke the law...The law is law crap will probably be pulled....Just for a conviction...The saying in Joliet goes..."Judged by 12 or Carried by 6 "

I have an aunt that shot and killed my uncle on my birthday...He was assaulting her after a night of drinking,which he normally did...She pulled out her 38 revolver and shot him...She did 30days in jail...He suffered the consequences of attacking a family member.I still do not believe in banning guns.If she didn't have the gun chances are she would of died.The wife that cooks,cleans,takes care of the kids,works,and does for her husband would of died..not the guy who attacks his family,gets drunk daily,curses and beats his kids when drunk...

I have no problems with guns, but what if they are convicted felons and aren't supposed to possess guns or if the guns were illegal? I say use to arrest being made. Laws are laws!

I understand it is the Law but if you are convicted of a Felony and have served your time, You lose the right to protect yourself? Hmmm...Is that fair?

A convicted felon loses the right to no longer bear arms, unless their record is expunged.

I understand that...But if you have done your time and are now a productive citizen you still can not defend yourself? What if someone breaks into your home or pulls a gun? You just have to take what you get which may include death? Does that seem right? This article made me think about that a little...

Anthony you are correct, people need to look at countries that have banned firearms. Homicides and crime increased after the ban. Facts are facts. Liberals like to deal in fantasy and their agenda's.

Maybe some new manhole lids with rubber rings to stop all the flooding of peoples houses,AndRead More actually climb down in the manhole and see if it is leaking instead of paying all of these people in Joliet getting flooded out by YOUR SANITARY System. Some paint being scrapped off the City Hall Hand Rails that will cut ya up.

Glad you made me cut the weeds down so these gang members have a place to spray paint and walk around feeling tough doing so.
